Behind every PROMOKANT deployment is kyo, our staffing unit: a licensed labour-leasing agency under Swiss AVG, bound by the GAV Personalverleih collective agreement. That means two things. You carry no employer duties on any deployment — whether sampling, POS activation, sales consultancy or merchandising. And every promoter, sampler and merchandiser is employed under Swiss labour law, paid to GAV minimums, and fully insured.
Employer status sits with kyo
Not with you. Not legally, not day-to-day, not in a dispute.
How the legal framework works
You
You commission PROMOKANT to execute a campaign. One contract, one invoice, one point of contact. You yourself enter no labour-leasing relationship.
PROMOKANT
Is the user enterprise (Einsatzbetrieb) under Swiss labour-leasing law — the company running the show on the ground. Rents the promoters, samplers and merchandisers from kyo, holds on-site instruction authority, and delivers the campaign as a whole.
kyo
Licensed staffing agency under Swiss AVG, bound by the GAV Personalverleih. Legal employer of every promoter, sampler and merchandiser. Handles recruiting, contracts, payroll, insurance and continuing education.
The result: the labour-leasing relationship sits between kyo and PROMOKANT. You yourself only buy the full-service campaign and stay outside that chain. No employer status, no instruction authority, no liability.

When something happens, the phone rings at kyo. Not at you.
Three situations that can happen on any larger sampling, POS or merchandising deployment. Here's how we handle them without ever involving you.
Accident at the POS
A sampling hostess slips at the train station and injures her knee. Incident report, UVG accident insurance, daily sickness benefits, insurer communication: all handled by kyo as the employer. You might read about it in the weekly report. No SUVA file on your desk.
Staff swap mid-deployment
You ask for a different line-up, or a promoter drops out. Replacement, payroll, legal handling: all through kyo. You get a new person within hours. No dismissal letter in your name, no HR file to manage.
Overtime and public holidays
A POS activation runs beyond the planned time or falls on a public holiday. Working-time records under Swiss labour law, GAV surcharges, payroll, statutory filings: all on kyo's side. Labour law stays compliant. You only see the clean end-of-campaign report.
